To ask the Minister of Finance and Personnel whether her Department has stipulated that a 'Swedish Derogation' and/or 'Regulation 10' clause be invoked when hiring temporary agency staff and temporary contract workers to fill posts within NICS, in order to circumvent the equal pay requirements under Regulation 5 of the Agency Workers' Regulations (NI) 2011.

No. I can confirm that no stipulation has ever been made by my Department with regards to invocation of ‘Swedish Derogation’ or ‘Regulation 10’ clause to circumvent the equal pay requirements under the Agency Workers’ Regulations (NI) 2011.
